適用｜APPLICABILITY

• 本サービスの利用者は十一社オンラインショップ利用規約（以下「本規約」と表記します）の内容をご理解いただき、本規約の全てに従うことに同意いただいているものとします。 また、本規約に同意できない者、または違反する者の閲覧、およびサービスの利用を禁止するものとします。

• 十一社は本サービスに関し、本規約のほか、ご利用にあたってのルール等、各種の定め（以下「個別規定」といいます）をすることがあります。これら個別規定はその名称のいかんに関わらず，本規約の一部を構成します。

• 本規約の定めが前項の個別規定の定めと矛盾する場合には、個別規定において特段の定めなき限り、個別規定の定めが優先されるものとします。

• Users using the Services offered on this website must abide by the Terms of Use. Those using the website are deemed to have agreed on the terms as written here.

• Any rules for use of the Services posted on our website shall constitute an integral part of these Terms of Use.

• If there is any conflict between these Terms of Use and the Rules or any other description of the Services not provided for herein, these Terms of Use shall prevail.

売買契約｜SALES CONTRACT

​

• 本サービスにおいては、利用者が十一社に対して購入の申し込みをし、これに対して十一社が当該申し込みを承諾した旨の通知をすることによって売買契約が成立します。なお、当該商品の所有権は、十一社が商品を配送業者に引き渡したときに、利用者に移転するものとします。

• 十一社は、利用者が以下のいずれかの事由に該当する場合には、当該利用者に事前に通知することなく、前項の売買契約を解除することができるものとします。

  • 利用者が本規約に違反した場合

  • 届け先不明や長期の不在のため商品の配送が完了しない場合

  • その他十一社とユーザーの信頼関係が損なわれたと認める場合

• 本サービスに関する決済方法、配送方法、購入の申し込みのキャンセル方法、または返品方法等については，別途当社が定める方法によります。

• In the Services, a User applies for the purchase to JUICHI-SYA, and a sales contract is established by notifying from JUICHI-SYA to that User that having consented to the application concerned for this.  Furthermore, the proprietary rights of the product shall concerned move to the User when JUICHI-SYA hand over the product to a delivery supplier.

• JUICHI-SYA assume that it's possible to release a sales contract of the preceding clause without our notifying the User concerned beforehand when the User comes under the following one of reasons:

  • ​If the User violates any of provisions hereof,

  • If delivery does not complete due to unknown destination or long-term absence,

  • In other cases, if JUICHI-SYA believe that the relationship of mutual trust between JUICHI-SYA and the User have been impaired.

• About the settlement method, delivery method, cancellation method for purchase application, or return method, etc. regarding the Services is according to the method that determined separately by JUICHI-SYA.

知的財産権｜INTELLECTUAL PROPERTY RIGHTS

​

「知的財産権」とは、著作権、特許権、実用新案権、意匠権、商標権その他の知的財産権（それらの権利を取得し、またはそれらの権利につき登録等を出願する権利を含みます。）を意味します。本サービスによって提供される商品写真その他のコンテンツ（以下「コンテンツ」といいます）の著作権又はその他の知的所有権は、十一社及びコンテンツ提供者などの正当な権利者に帰属し、利用者はこれらを無断で複製、転載、改変、その他の二次利用をすることはできません。

“Intellectual Property Rights” shall mean copyrights, patents, utility rights, design rights trademarks, and any other intellectual property rights (including rights to file for the registration of such rights.). Copyrights and other Intellectual Property Rights of product photos and other content (hereinafter referred to as "content") provided by this service belong to the legitimate right holder such as the Company and contents providers, and the Users may not copy, reprint, alter, or otherwise use them without permission.

禁止事項｜PROHIBITED ACTIONS

​

利用者が、以下の行為（以下「禁止事項」と表記します）を行うことを禁じます。該当行為が発覚した際は、十一社が必要と判断した処置を行います。以下に定める禁止事項に違反したことにより利用者に損害が生じた場合、十一社はその責任を一切負いません。また、十一社が損害を被った場合は、禁止事項に違反した利用者がそれを賠償する義務を負うものとします。

• 本規約、および利用規約に違反する行為

• 法令または公序良俗に違反する行為

• 犯罪行為に関連する行為

• 本サービスに含まれる当社または他の第三者の著作権、商標権、肖像権、プライバシー権、知的財産権、評判その他の権利または利益を侵害する行為

• 十一社の利用するサーバーまたはネットワークに著しく負担をかけたり、機能を破壊したり，妨害したりする一切の行為（ハッキング等を含むがこれらに限られない）

• 本サービスによって得られた情報を商業的に利用する行為

• 十一社のサービスの運営を妨害するおそれのある行為

• 不正アクセスをし、またはこれを試みる行為

• 他のユーザーに関する個人情報等を収集または蓄積する行為

• 他のユーザーに成りすましたり、虚偽、または誤解を招くような内容を含む情報を登録する行為

• 十一社のサービスに関連して、反社会的勢力に対して直接または間接に利益を供与する行為

• その他、十一社の信用を毀損・失墜させるなど、十一社が不適当であると合理的に判断する行為

When using the Services, the Users may not conduct in the following acts or any act that JUCIHI-SYA determines falls under any of the following that:

• Acts that violate provisions hereof and this Terms of Use,

• Acts that violate any law or public order and good morals,

• Acts related to criminal act,

• Acts that infringe any copyrights, trademark rights, portrait rights, privacy rights, Intellectual Property Rights, reputation or other rights or profit of JUICHI-SYA or other third parties included in the Services,

• Any acts that place an excessive burden, destroys or interferes with the functions the servers or networks used by JUICHI-SYA (including but not limited to hacking, etc.) , 

• Acts to use informations obtained by the Services commercially,

• Acts that threaten to interrupt the operation of the Services,

• Acts to access or attempt to access the system, network, etc. of the Services improperly,

• Acts collecting or storing personal information about other users of the Services,

• Acts to impersonate a third party, or registering information that contains false or misleading content,

• Acts that directly or indirectly provide profit to Antisocial Forces in connection with the Services,

• Other acts that JUICHI-SYA deems to be inappropriate.

When JUICHI-SYA find out the corresponding action for the User, we will take measures that we deem necessary. JUICHI-SYA shall, in no event, be liable for damages incurred by the User arising out of such measures taken by us. Furthermore, if JUICHI-SYA suffers damages, the User who violates the prohibited matter is obliged to compensate for it.

本サービスの提供の停止等｜SUSPENSION OF THE SERVICES

​

• 十一社は、本サービスを正常に運営するために、以下のような場合、利用者に事前に通知することなく本サービスの全てもしくは一部の機能を中断・停止・廃止することができるものとします。

  • 本サービスにかかるコンピュータシステムの保守点検または更新を行う場合

  • 地震，落雷，火災，停電または天災などの不可抗力により，本サービスの提供が困難となった場合

  • コンピュータまたは通信回線等が事故により停止した場合

  • その他，十一社が本サービスの提供が困難と判断した場合

• 十一社は，本サービスの提供の停止または中断により，利用者または第三者が被ったいかなる不利益または損害について，理由を問わず一切の責任を負わないものとします。

• JUICHI-SYA shall be entitled to, without any advance notice to the User, suspend or discontinue the Services, in whole or in part, in the event that:

  • Inspection or maintenance of the computer system for the Services needs to be performed due to urgent circumstances;

  • The Company becomes unable to provide the Services due to force majeure, including but not limited to earthquake, lightning, fire, storm and flood damage, power blackout and other natural disasters; or

  • Computers or communication lines have been disrupted due to an accident;

  • The Company determines that suspension or discontinuance is required for other reasons.

• Excluding cases of malice or gross neglect on the part of the Company, and excluding cases where the User qualifies as a Consumer as defined under the Consumer Contract Act, the Company shall not be liable for any damages incurred by the User arising out of any actions taken by the Company pursuant to this Article.

利用制限および登録抹消｜REGISTRATION CANCELLATION

​

十一社は、以下のいずれかに該当する場合には、事前の通知なく、利用者に対し本サービスの全部もしくは一部の利用を制限し、または利用者としての登録を抹消することができるものとします。

• 本規約のいずれかの条項に違反した場合

• 登録事項に虚偽の事実があることが判明した場合

• 決済手段として当該ユーザーが届け出たクレジットカードが利用停止となった場合

• 料金等の支払債務の不履行があった場合

• 当社からの連絡に対し，一定期間返答がない場合

• 本サービスについて，最終の利用から一定期間利用がない場合

• その他、十一社が本サービスの利用を適当でないと判断した場合

• 十一社は，本条に基づき当社が行った行為によりユーザーに生じた損害について，一切の責任を負いません。

JUICHI-SYA may provisionally suspend use by the User of the Services, cancel the registered User’s registration as such or terminate the Service agreement, in the event of any of the following without prior notice or demand.

• If the User violate for any of provisions hereof.

• If it turns out that there is a false in any of the registration Information.

• If the credit card that the User has reported as a means of payment is suspension of use.

• If there was a default for payment obligations such as fees.

• If there is no reply in a fixed period to the contact from us.

• If this Services has not been used for a certain period since the User last use.

• If we determines that it is inappropriate for the User use the Services.

• If we otherwise determines that it is inappropriate for the User use the Services.

• JUICHI-SYA shall not be liable for any damages incurred by the User arising out of, or in connection with, any actions taken by us pursuant to this Article.

保証の否認および免責事項｜DISCLAIMER AND WAIVER OF WARRANTIES

​

• 十一社は、本サービスに事実上または法律上の瑕疵（安全性、信頼性、正確性、完全性、有効性、特定の目的への適合性、セキュリティなどに関する欠陥、エラーやバグ、権利侵害などを含みます）がないことを保証するものではありません。また、その情報の利用にあたり生じた損害・トラブルについて、十一社はいかなる責任も負いません。しかし記載されている情報に明らかな間違いがある場合や、利用者の信頼を損ねていると思われる場合は、速やかに訂正・削除いたしますので、大変お手数ですが、"CONTACT"ページより十一社までご連絡ください。

• 十一社は、本サービスによって利用者に生じたあらゆる損害について一切の責任を負いません。ただし、本サービスに関する十一社と利用者との間の契約（本規約を含みます）が消費者契約法に定める消費者契約となる場合、この免責規定は適用されませんが、この場合であっても十一社は、十一社の過失（重過失を除きます）による債務不履行または不法行為により利用者に生じた損害のうち特別な事情から生じた損害（十一社または利用者が損害発生につき予見し、または予見し得た場合を含みます）について一切の責任を負いません。

• 通信回線やコンピューターなどの障害によるシステムの中断、遅滞、中止、データの消失、不正アクセスにより生じた損害、その他十一社のサービスに関して利用者に生じた損害について、十一社はいかなる責任も負いません。

• 十一社は本サービスに関して、利用者と他の利用者または第三者との間において生じた取引、連絡または紛争等について一切責任を負いません。

• 天災、災害、および当社が防ぎ得ない外的要因・事由により、利用者に損害を与えた場合、十一社はいかなる責任も負いません。

• JUICHI-SYA do not guarantee that this Services have no actual or legal inaccuracies (including but not limited to any representation that safety, reliability, accuracy, completeness, effectiveness, suitability for a specific purpose, security flaws, errors or bugs, infringement of rights etc). In addition, we do not take any responsibility for damage or problems that occur in using the information. However, if there is an obvious mistake in the information listed, or if you believe that the user's trust is undermined, we will promptly correct or delete it, so please contact us from "CONTACT" page.

• JUICHI-SYA do not take any liability for any damages caused to the Users by using this Services. However, this disclaimer does not apply if the contract (including this Terms of Use) between JUICHI-SYA and users regarding this service is a consumer contract specified in the Consumer Contract Act. But even in this case we do not take any liability for the damage caused by special circumstances (including cases where we or the user foresees or was able to foresee the occurrence of the damage), among the damages caused to the user by default or tort due to our negligence (excluding serious negligence) .

• Under no circumstances shall JUICHI-SYA be liable for any damages incurred for system interruptions, delays, cancellations, loss of data, damage caused by unauthorized access, damage to users by a failure such as communication line or computer, or otherwise damages incurred by the User in connection with our services. 

• JUCIHI-SYA shall not in any way be liable for transactions, communications or disputes arising between the User and other Users or a third party in connection with the Services or the Website.

• JUICHI-SYA do not take any liability for any damages caused to Users due to natural disasters, disasters, or external factors or events that we can not prevent.

サービス内容の変更等｜SERVICES MODIFICATION AND TERMINATION

​

十一社は利用者に通知することなく、本サービスの内容を変更しまたは本サービスの提供を中止することができるものとし、これによって利用者に生じた損害について一切の責任を負いません。

JUICHI-SYA shall be entitled to at any time modify Service content or terminate the provision of Services in its own discretion. JUICHI-SYA shall not be liable for any damages incurred by the User arising out of, or in connection with, any actions taken by JUICHI-SYA pursuant to this.

本規約の変更｜AMENDMENTS

​

十一社は、必要と判断した場合には利用者に通知することなく、また利用者の承諾なく、いつでも本規約を変更することができるものとします。なお、本規約の変更後本サービスの利用を開始した場合には、利用者は変更後の規約に同意したものとみなします。

JUICHI-SYA reserves the right to amend or change the Terms of Use any time at its own discretion. Unless JUICHI-SYA declares otherwise, the amended or changed Terms of Use will be effective from the time displayed on the new Terms of Use. If the User uses the Service after the point that the new Terms of Use have come into operation, the User shall be deemed to have agreed to such amend or change to these Terms of Use.

個人情報の取扱い｜TREATMENT OF USER INFORMATION

​

• 十一社は、本サービスの利用によって取得する個人情報については「プライバシーポリシー」に従い適切に取り扱うものとし、利用者はこのプライバシーポリシーに従って十一社が利用者の利用者情報を取扱うことについて同意するものとします。

• 十一社は、本サービスの提供にあたり、登録ユーザーから以下の情報を取得します。

  • 氏名

  • メールアドレス

  • 住所

  • 電話番号

  • 上記の他、その他十一社が定める入力フォームに利用者が入力する情報

  • その他、IPアドレス、クッキー情報、利用者の利用環境等の情報を利用者のブラウザから自動的に受け取り、サーバーに蓄積する場合があります。

• 十一社は、原則として利用者が登録した情報を第三者に開示することはありませんが、本サービスの運営を委託する委託先に対し、必要最低限の範囲において開示することがあります。

• 十一社は、利用者が当社に提供した情報、データ等を、個人を特定できない形での統計的な情報として、当社の裁量で、利用及び公開することができるものとし、利用者はこれに異議を唱えないものとします。

• Treatment by JUICHI-SYA of the User’s information shall be subject to the provisions of our Privacy Policy, which are separately prescribed, and the User hereby agrees to treatment by JUICHI-SYA of the User’s information subject to such Privacy Policy.

• JUICHI-SYA will obtain the following information about the User of the services:

  • Name

  • E-mail address

  • Address

  • Phone number

  • ​Other information entered by the user into such form as specified by JUICHI-SYA

  • Other information such as IP Address, cookies, and the User environment data may be taken automatically from the User's browser and stored by the server.

• In principle, JUICHI-SYA will not disclose information registered by the User to any third party but said information may be disclosed to subcontracts to the minimum extent required for the consignment of Service operations.

• JUICHI-SYA may, in its sole discretion, use or make public any information or data provided by the User to JUICHI-SYA as statistical information in a form that cannot identify an individual, and the User may not challenge or dispute such use.

通知または連絡｜NOTICES

​

利用者と十一社との間の通知または連絡は、十一社の定める方法によって行うものとします。十一社は、利用者から十一社が別途定める方式に従った変更届け出がない限り、現在登録されている連絡先が有効なものとみなして当該連絡先へ通知または連絡を行い、これらは発信時に利用者へ到達したものとみなします。

 

Any inquiries with respect to the Services or other communications or notices from the User to JUICHI-SYA, or other communications or notices from JUICHI-SYA to the User shall be made in accordance with the procedures specified by JUICHI-SYA.

権利義務の譲渡の禁止｜ASSIGNMENT

​

利用者は、当社の書面による事前の承諾なく、利用契約上の地位または本規約に基づく権利もしくは義務を第三者に譲渡し、または担保に供することはできません。​

The User shall not assign, transfer, grant security interests in or otherwise dispose of its status under the Service Agreement or its rights or obligations under the Terms of Use without the prior written consent of JUICHI-SYA.

準拠法および管轄裁判所について｜GOVERNING LAW AND JURISDICTION

​

• 本規約の解釈にあたっては、日本法を準拠法とします。なお本サービスに関しては、国際物品売買契約に関する国際連合条約の適用を排除します。

• 本規約の準拠法は日本法とします。本サービスまたは本規約について紛争が生じた場合には、誠意を持って協議いたしますが、解決しない場合には東京地方裁判所を第一審の専属的合意管轄裁判所とします。

• This Terms of Use shall be governed by the laws of Japan. If there are sales of goods in the Services, the United Nations Convention on Contracts for the International Sales of Goods (CISG) shall not apply.

• Any and all dispute arising out of or in connection with this Terms of Use shall be submitted to the exclusive jurisdiction of the Tokyo District Court in the First instance.
